Texas law requires cops to observe you for 15 minutes before a breath test. Not 14 minutes and 58 seconds. Not “close enough.” EXACTLY 15 minutes.
One second short and your breath test gets thrown out. We check the Black Mamba logs that prove when the machine started. Get an attorney who knows this stuff.

My neighbor ran over a kid while drunk and broke both the kids legs. He got off on a technicality with a great lawyer and the case was thrown out. He still drives drunk regularly and loves it
Why isn’t the lawyer telling people to not submit to a breath test?
I love all these haters that don’t know the law. It’s not illegal to drink and then drive in all 50 US States. You just can’t be intoxicated and then drive. And until the US makes it only 0.000 then people will always be judged by imperfect science with human error. If you don’t like it, move to a country that outlaws drinking and then driving. Google them! I hear Yemen is nice this time of year.

Not following 15 min observation period wont get it suppressed in CA. Goes to weight not admissibility.
This is NOT legal advice……… in my humble non attorney opinion, blood drawing is a 4th amendment question…… as far as the breath goes they need to take two samples. If you’re an asthmatic and blowing is difficult, after all the labored breathing and blowing from the first test you could be at risk of an asthma attack…..if they can’t get to your albuterol they’ll need to bring you to the hospital, where you don’t consent to having your blood drawn….
I hope this attorneys family is struck and killed by a drunk driver
